Kerala High Court upholds Lok Ayukta order in money misappropriation case
The Kerala High Court affirmed the Lok Ayukta Division Bench's judgement referring an alleged misuse of the Chief Minister's Distress Relief Fund (CMDRF) to its Full Bench on Tuesday.
A High Court Division Bench comprised of Chief Justice A.J. Desai and Justice V.G. Arun dismissed R.S. Sasikumar's appeal contesting Lok Ayukta's ruling.
The petitioner had petitioned the Lok Ayukta against the former Left Democratic Front administration, led by Chief Minister Pinarayi Vijayan, for allegedly releasing funds to ineligible people.
Mr. Sasikumar claimed that the Lok Ayukta committed judicial misconduct by sending the question of petition maintainability to the full Bench, which had previously been adjudicated by a Bench led by Lok Ayukta Pius C. Kuriakose.
When the issue was heard, a Full Bench of the Lok Ayukta decided that it may hear petitions against Cabinet decisions.
The Lok Ayukta's Division Bench then heard the petition and scheduled the hearing for March 18, 2022. The petitioner later appealed to the High Court after the Lok Ayukta Division Bench failed to provide orders even after reserving it for one year.
