India Moves to Make IT Advisories Binding on Tech Platforms

The Indian government has proposed new rules to make its advisories legally binding on major internet platforms, aiming to strengthen compliance and accountability.

Under the proposed changes announced on Tuesday, platforms such as Meta, Google, and X would be required to follow advisories issued by the IT Ministry. Non-compliance could result in the loss of “safe harbour” protection, which currently shields platforms from liability for user-generated content.

The government said the move is intended to improve legal clarity and ensure stronger enforcement of its directions. A public notice has invited feedback on the proposed rules until April 14.

Earlier this year, the government also reduced the time for platforms to remove flagged content from 36 hours to just three hours. It has introduced new requirements related to artificial intelligence-generated content and deepfakes as well.

At present, advisories from the IT Ministry act as guidance without direct legal consequences. The proposed changes aim to give them stronger legal backing.

The development reflects ongoing efforts to create a more accountable and regulated digital ecosystem in India.
